19 जुलाई को मजीठिया के मामले की अंतिम सुनवाई

 सुप्रीम कोर्ट में प्रिंट मीडियाकर्मियों के मजीठिया वेज बोर्ड मामले की सुनवाई है. विद्वान न्यायाधीश ने आखिरी सुनवाई की तारीख तय कर दी. 19 जुलाई को फैसला आ जाएगा. फाइनल हियरिंग की तारीख तय होने से मीडियाकर्मी खुश हैं. कोर्ट ने लंबी तारीख इसलिए भी दी है ताकि मीडिया मालिक खुद अपने स्तर पर अपनी कमियों को दुरुस्त कर पीड़ितों को राहत दे दें अन्यथा सुप्रीम कोर्ट को फैसला सुनाना पड़ जाएगा. देखना है कि 19 जुलाई के पहले मीडिया मालिक खुद न्याय कर पाते हैं या फिर सुप्रीम कोर्ट की लाठी का इंतजार करते हैं. आज हुई सुनवाई और पूरे मामले की विस्तृत रपट जाने माने वकील परमानंद पांडेय ने भड़ास को मेल से भेजा है, जिसे नीचे प्रकाशित किया जा रहा है.
All the contempt petitions against the newspaper owners for not implementing the Majithia Award have been listed for final hearing on 19th July 2016. Those states, which have still not filed the status report have been given the last chance to file the same, otherwise the Chief Secretaries of the concerned states will have to be psychically present in the Supreme Court on the next date of hearing to explain as to why they should not be hauled up.
It may be noted that the Majithia Report was submitted to the Government of India on 31st December 2010 but before it could be notified by the Government, the proprietors of newspapers led by Anand Bazar Patrika and Bennett Colman & Company approached the Supreme Court of India for quashing of the Working Journalists Act and the Majithia Wage Board recommendations.
However, on the direction of the Supreme Court the Government notified the recommendations on 11.11.2011 subject, of course, to the decision of the Supreme Court in the Writ Petition (C) No. 246/2011. After marathon hearings the bench consisting of the then Chief Justice of India Shri Sathashivam, Justice Ranjan Gogoi and Justice Shiv Kirti Singh dismissed all the petitions of the newspaper owners, upholding the Working Journalists Act and the Majithia Wage Boards constituted thereunder. The judgment of the Supreme Court came on 07.02.2014 and the newspapers were given time to disburse all arrears in four instalments within one year and pay the salaries to employees from April, payable in the month of May 2016.
Some of the newspapers, no doubt, implemented the Majithia Award but most of them failed to honour the verdict of the Supreme Court. Majority of newspapers which have been violating the directions of the Supreme Court are from the Hindi heartland like; Dainik Jagran, Dainik Bhaskar and Rajasthan Patrika. These newspapers brazenly adopted the coercive methods to get undertaking from employees ‘that they are satisfied with the salaries which they are getting and they do not want the Majithia Award to be implemented in the organisation they work for’. These newspapers also arbitrarily changed the designations of the employees to deny them Majithia Award. Even clerical employees have been designated as the Managers or the Executives.
